Terms of Use & Service / End-User License Agreement
By using Taking Monday, whether by downloading, conducting activities as a viewer, an Anonymous user, or a user with a registered account, you (the user of Taking Monday software, applications, platform) agree to not type, post or send messages on any Taking Monday related page that is abusive to others, objectionable, offensive, intolerant, violates or infringes some else's rights of publicity, privacy, copyright, trademark, or intellectual property, defames, spams, solicits, bullies, harasses, intimidates, or counter to the spirit of Taking Monday's culture of goodwill, kindness and social impact. You also agree to our Privacy Policy & User Deletion process. You agree that you will not use or develop third party applications that interact with Taking Monday, use services that would interfere with, disrupt, negatively effect, inhibit other users, or disable, overburden, impart the functioning of services or damage Taking Monday, attempt to use another user's email or password without their permission, post content that contains links that violate these terms, graphic violence, threats, hate speech, or incitements to violence, upload viruses or other malicious code to compromise or test our security, use services to conduct any illegal activities, use a robot, spider, crawler, scraper or other automated means to interfere with Taking Monday or extra user information, attempt to circumvent any content-filtering techniques we employ, or attempt to access Platform areas that you are unauthorized to access, and encourage others to violate any of our terms. Any violation of these terms, above or below, may result in being blocked from Taking Monday at the sole discretion of the Taking Monday team.
Developer will act on objectionable content reports within 24 hours by removing the content and ejecting the user who provided the offending content.
You are responsible for your use of the Services and for any Content (such as "Mondays") you provide, including compliance with applicable laws, rules, and regulations. You should only provide Content that you are comfortable sharing with others. We reserve the right to remove Content.
By submitting, posting or displaying Content on or through the Services, you grant us a worldwide, non-exclusive, royalty-free license and sublicense to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such Content in any and all media or distribution methods now known or later developed (including curating, transforming, and translating). This includes, but is not limited to, re-posting your Taking Monday posting on a different social media platform for promotional purposes. This license authorizes us to make your Content available to the rest of the world and to let others do the same. You agree that this license includes the right for Taking Monday to provide, promote, and improve the Services and to make Content submitted to or through the Services available to other organizations or individuals for the syndication, broadcast, distribution, re-post, promotion or publication of such Content on other media and services. Such additional uses by Taking Monday, or other companies, organizations or individuals, is made with no compensation paid to you with respect to the Content that you submit, post, transmit or otherwise make available.
You may need to create an account to use some of our Services. You are responsible for safeguarding your account, so use a strong password and limit its use to this account. We cannot and will not be liable for any loss or damage arising from your failure to comply with the above. Your access to and use of the Services or any Content are at your own risk. You understand and agree that the Services are provided to you on an “AS IS” and “AS AVAILABLE” basis. We may revise these Terms from time to time.
Taking Monday has an evolving set of rules for how partners can interact with your Content on the Services. You understand that we may modify or adapt your Content as it is distributed, syndicated, published, or broadcast by us and our partners and/or make changes to your Content in order to adapt the Content to different media.
You represent and warrant that you have, or have obtained, all rights, licenses, consents, permissions, power and/or authority necessary to grant the rights granted herein for any Content that you submit, post or display on or through the Services. You agree that such Content will not contain material subject to copyright or other proprietary rights, unless you have necessary permission or are otherwise legally entitled to post the material and to grant Taking Monday the license described above. You agree to use a legitimate email address, that you have the right to access and control, when registering for and using Taking Monday.
Any use or reliance on any Content or materials posted via the Services or obtained by you through the Services is at your own risk. We do not endorse, support, represent or guarantee the completeness, truthfulness, accuracy, or reliability of any Content or communications posted via the Services or endorse any opinions expressed via the Services. You understand that by using the Services, you may be exposed to Content that might be offensive, harmful, inaccurate or otherwise inappropriate, or in some cases, postings that have been mislabeled or are otherwise deceptive. All Content is the sole responsibility of the person who originated such Content. We may not monitor or control the Content posted via the Services and, we cannot take responsibility for such Content.
You agree that Taking Monday and its third-party providers and partners may place advertising on the Services or in connection with the display of Content or information from the Services whether submitted by you or others. You also agree not to misuse our Services, for example, by interfering with them or accessing them using a method other than the interface intended to be provided. You may not do any of the following while accessing or using the Services: access, tamper with, or use non-public areas of the Services, Taking Monday’s computer systems, or the technical delivery systems of Taking Monday’s providers; probe, scan, or test the vulnerability of any system or network or breach or circumvent any security or authentication measures; access or search or attempt to access or search the Services by any means (automated or otherwise) other than through our currently available, published interfaces that are provided by Taking Monday (and only pursuant to the applicable terms and conditions); forge any TCP/IP packet header or any part of the header information in any email or posting, or in any way use the Services to send altered, deceptive or false source-identifying information; or (v) interfere with, or disrupt, (or attempt to do so), the access of any user, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, mail-bombing the Services, or by scripting the creation of Content in such a manner as to interfere with or create an undue burden on the Services.
In no event shall Taking Monday ("TM", "Taking Monday LLC", "TakingMonday", "TakingMonday.org", "our organization", "our", "we", "us" or equivalent terminologies) or its affiliates and their respective partners, employees, volunteers, donors, interns, board members, affiliates and agents (collectively “related persons”) be liable for any claims, liabilities, losses, costs, damages or injuries, including, but not limited to, any direct, indirect, punitive, special, incidental, or consequential damages arising out of or in connection with any access, use, engagement, inability to use, or distribution of our services and/or technology, and their content, updates, suggestions, links, user engagements, or a service and/or technology linked to our technology including any damages or injury caused by any failure of service, performance, or transmission, computer/device virus, communication line failure, other computer/device malfunction, theft, destruction or unauthorized access to, alteration of or use of any asset, whether for breach of contract, tortious behavior, negligence or under any other cause of action, or any content obtained through use and/or viewing of the service and technology. This is true even if Taking Monday or related persons have been advised of possibility of such damages or losses.
Services and technology provided by Taking Monday and/or related persons are on an “as is” and “as available” basis. Taking Monday makes no representation or warranties of any kind, express or implied, as to the operation of services and/or technology or the information included in our services or on our technology including any representations or warranties with respect to merchantability, certification or fitness for a particular service or purpose, title, non-infringement, availability, security, accuracy, freedom from viruses or malware, completeness, timeliness, functionality, reliability, sequencing or speed of delivery. By viewing and/or using, you expressly agree that your use of our services and/or technology is at your sole risk. Information, suggestions, links and advice provided through our services and technology is not intended and shall not constitute professional counseling, medical advise, diagnosis or treatment. In addition, nothing from our services or on our technology is intended to constitute legal advice. If engaging with Taking Monday and/or technology is forbidden by your state and/or locality, you are responsible for not using and/or viewing our services and/or technology. Taking Monday does not have the technology to independently verify with 100% accuracy where users, visitors or service recipients are located.
